Shimano Inc., filed trademark application for the word mark “”SEIS” under application no. 4-2008-12454 for the goods of “Electric Bicycle; bike; parts and accessories thereof, ect” in Class 12. The application was refused registration on the grounds that the applied-for mark was confusingly similarity to the earlier mark “SEI & Fig” under Registration no. 44993 as depicted below.

Invenco on behalf of Shimano Inc, filed an appeal against the Refusal on the grounds that the marks at issue are different as to sound, commercial impression. As such, the cited trademark owner has grant a letter of consent to allow Shimano Inc., to use and register the “SEIS” mark in Vietnam.

The National Office of Intellectual Property agrees with the Invenco’s arguments, and withdraws its Decision on Refusal on October 12, 2018 accordingly.
